코로나바이러스감염증-19 mRNA 백신 운반 지질 나노 입자 분쟁
2022년 3월 17일, 미국 기업인 앨나이램 파마슈티컬스(Alnylam Pharmaceuticals)가 미국 기업인 화이자(Pfizer)와 모더나 테라퓨틱스(Moderna Therapeutics)를 상대로 양사가 mRNA 기반 ‘코로나19’ 백신을 제조‧발매하는 과정에서 미국 특허 US 11,246,933을 침해하고 있다며 미국 델라웨어 지방법원에 소를 제기하였습니다.
상기 특허의 특허권자인 Alnylam Pharmaceuticals는 제1형 원발성 고수산뇨증(PH1) 치료제 ‘옥스루모’(Oxlumo: 루마시란)와 유전성 트랜스티레틴 매개성 아밀로이드증(hATTR) 치료제 ‘온파트로’(Onpattro: 파티시란), 급성 간성 포르피린증 치료제 ‘지블라리’(Givlaari: 지보시란) 등 RNA 간섭(RNAi) 기술이 적용된 유망신약들을 개발하는 회사입니다. 상기 특허는 RNA에 기초한 치료제 또는 백신을 체내에 안전하게 운반하는 지질 나노 입자를 형성하기 위해 사용되는 양이온성 생분해성 지질에 관한 것입니다(“Alnylam LNP Technology”).
상기 특허의 대표 청구항은 다음과 같습니다:
A cationic lipid comprising a primary group and two biodegradable hydrophobic tails, wherein the primary group comprises (i) a head group that optionally comprises a primary, secondary, or tertiary amine, and (ii) a central moiety to which the head group and the two biodegradable hydrophobic tails are directly bonded; the central moiety is a central carbon or nitrogen atom; each biodegradable hydrophobic tail independently has the formula -(hydrophobic chain)-(biodegradable group)-(hydrophobic chain), wherein the biodegradable group is --OC(O)-- or --C(O)O--; for at least one biodegradable hydrophobic tail, the terminal hydrophobic chain in the biodegradable hydrophobic tail is a branched alkyl, where the branching occurs at the α-position relative to the biodegradable group and the biodegradable hydrophobic tail has the formula --R12-M1-R13, where R12 is a C4-C14 alkylene or C4-C14 alkenylene, M1 is the biodegradable group, R13 is a branched C10-C20 alkyl, and the total carbon atom content of the tail --R12-M1-R13 is 21 to 26; in at least one hydrophobic tail, the biodegradable group is separated from a terminus of the hydrophobic tail by from 6 to 12 carbon atoms; and the lipid has a pKa in the range of about 4 to about 11 and a logP of at least 10.1. 한편, Pfizer는 2020년 독일 BioNTech과 코로나바이러스감염증-19에 대한 mRNA 백신을 공동으로 개발하여 FDA로부터 긴급사용승인을 받아 상품명 ‘코미나티주(COMIRNATY®)’로 판매 중이며, 2021년 완전승인을 받았습니다. 또한, Moderna Therapeutics는 2020년 mRNA 백신 상품명 ‘스파이크백스(SPIKEVAX®)’를 FDA로부터 긴급사용승인을 받은 후 판매 중이며, 2022년 완전승인을 받았습니다.
